Cumbria Update: Time Off In Lieu backdated as pay for Bank Holidays worked

The Agenda for Change Terms & Conditions Handbook states that any employee working a Bank Holiday is paid 7.5 hours. Therefore staff who work more than 7.5 hours on a Bank Holiday e.g. 10 Hours or 12 hours should have the remaining hours worked paid as TOIL.

Unfortunately staff working in the Cumbria Area has never had this TOIL paid. Having raised this with NWAS NHS Trust backdated TOIL will be paid at plain time. This will be backdated to December 2004 for those stations working more than 7.5 hour shifts.

PROMIS have only records of those staff who worked a Bank Holiday since 2006; however, the Trust has requested that the information is obtained through the signing on sheets.

The information supplied through PROMIS has unfortunately been collated incorrectly. For staff who worked 12 hours on a Bank Holiday 4.5 hours should have been paid. For 10 hour shifts it should be 2.5 hours.

The Agenda for Change Handbook states that for any unsocial hours worked short meal breaks are not to be taken into account.

Although some staff have been paid already UNISON believes that this is not the correct amount.
UNISON will be trying to make sure that this pay is correctly redeemed.
